The Renisha McBride story

There’s a New York Times story that has a surprisingly large amount of factual information.

Renisha McBride was 5’4” and weighed 184 pounds. Her blood-alcohol measurement was 0.218% at 3:40 AM when she was killed, which is extremely drunk. I can really appreciate how drunk that is because back when I was in the “prosecutor clinic” in law school, the adjunct professor had us go out drinking to try to get as drunk as possible, and then walk over to the DUI van which was parked across the street at the parking lots for the Tempe courts, to get a feel for what these measurements really mean. All I was able to blow was 0.14 (I won the contest!) and I was totally wasted, barely in any state to walk home let alone drive a car. In order to get that drunk, I was drinking vodka on the rocks mixed in with Jaeger shots. Yet Renisha had BAC of approximately 0.26 at the time of the accident at 1:00 AM (given that alcohol burns off at 0.015/hour).

Thus the mystery of what she was doing for two hours and forty minutes is pretty obvious, she probably passed out, and when she woke up she probably didn’t even remember being in an accident. Although maybe she was aware enough at the time of the accident that she should get away from the scene of the crime to avoid getting arrested for drunk driving. Of course, with Detroit police taking forty minutes to respond to 911 calls, she probably didn’t have to worry about that.

The homeowner who shot her is described as “white,” but given that this is Dearborn Michigan, there is a very good chance that he was a dark-complected Arab Muslim and not a pale-white European Christian.

This is a lesson to people who think it’s a great idea to own a gun for home defense. Without a gun, he would have just called the police (and this is in Dearborn MI, not bordering Detroit MI where Renisha crashed her dar, so the police would have actually responded to the call), and suffered little more harm than some property damage from the crazy drunk fat black woman. But because he had a gun, he felt emboldened to take matters into his own hands. When he goes to prison, the black inmates will probably kill him. Remember what happened to Jeffrey Dahmer?

* * *

I was wrong about the homeowner being an Arab. Theodore Wafer looks like a prole white, and his name isn’t Arabic.

Unless there are some new facts I don’t know about, I find it highly likely he will be convicted.

  2. Remember what happened to Jeffrey Dahmer?

Read up on it – Jeffrey Dahmer begged to be able to spend more time around other inmates, and filed endless lawsuits and appeals to be given more freedom and privileges. He was quite the pest and made himself hated by prison staff, and they were forced to yield despite knowing the security risks. Otherwise, he could have been completely (physically) safe for his whole prison life.

    • I agree with this and what massivefocusedinaction posted below. As one of Lion’s few degenerate, functional alcoholic, low life, prole, loser readers go I’d estimate that I feel about as drunk as I want to be with a BAC that hovers between .30 and .35. I’ve been drinking for four+ hours since posting this reply and it’s Friday, and even though I can’t say for sure, I’d estimate that I’ve had around 12 drinks so far and I still have a bottle of wine to kill. Not only that, but I’ll wake up feeling just fine in the morning. Drink harder, Lion, and post while you do.

He talked to a publication (I forget which one, but I think it was British) while using his real name, linked the article on his blog, and was then attacked by a female blogger that he used to feud with. I highly doubt that our beloved Lion would be likely to make a similar mistake if he were blogging while drunk. Once again, please get drunk and post, Lion.

  6. From everything I’ve read about this situation there doesn’t seem much to mitigate the crime. It’s hard to claim self defense when your “attacker” never got in the house. Seems like she was too drunk to know it wasn’t her house and he probably just woke up and didn’t know what was going on.

  7. Well thankfully the reporting is much less sensational than what we saw during the Zimmerman fiasco.
Omitted, however, is the confounding wrinkle that the homeowner claims it was an accidental discharge.

With regard to her behavior, she might have suffered a concussion in addition to being drunk.

“Without a gun, he would have just called the police”
Agree he was likely emboldened (that’s sorta the objective), but many/most gun owners would have also just called police, assuming she was merely screaming and incessantly ringing the doorbell and not breaking windows or trying to kick-in the door.

Still don’t know a lot of facts, but it seems to be a much greyer case than Zimmerman-Martin.

  9. Your little example ignores tolerance, a bunch of regularly non-drinkers are going to be very drunk at fairly low BAC levels, while heavy drinkers regularly appear not impaired while passed the legal drunk limits and crank their BACs to levels that would kill non-drinkers.

“He was woken up between 3:30 a.m. and 4:30 a.m., and McBride never once said anything or cried for help,” said [Wafer's attorney]. “She just attempted to get into his house using the front door and also the side door and so that just scared the hell out of him.”

Here’s his house. It is somewhat understandable how someone going back-and-forth between the front door and side door at 4AM would get the adrenaline flowing. That said, if he was in fear for his life he shouldn’t/wouldn’t have opened his door.

  12. Sounds like the guy was alarmed by noises downstairs, came downstairs with a gun, and panicked (or maybe he just got angry and became careless). If you can’t reasonably deal with life-or-death situations when tired, frightened, and/or enraged, there are serious risks to having a gun. Same if your training is so bad that you might pull the trigger without intending to.

The article doesn’t seem to say whether McBride was shot through a door or window, or if Wafer opened the door and got into some sort of confrontation before opening fire. If he was inside and she was outside, he’ll have a really hard time arguing self-defense.

I once had a run in with the police where they arrived at my house late at night thinking the previous owner still lived here. They were plainclothed, beating, pounding on the door, rattling and turning the knob. I never heard them announce they were the police. I truly believed I was in mortal danger.

The shooter may not have realized it was a woman, either. Remember the case on SI where a white home owner mistook a black woman for a black man during hurricane sandy.

  14. Should Israeli settlers simply accept the property damage caused by Qassam rockets reigning down on them? Is the IDF “emboldened” when they bomb Gaza, Lebanon, and the West Bank? Murkan elites consider this pretty acceptable. They even assist Israel in proactively assassinating enemies including non-violent ones like atomic scientists. The diversity hordes meanwhile have done far more damage to American citizens and yet merely defending yourself and possessions is considered a crime.

  16. A Twitter sleuth found the address of McBride’s mother’s house and posted side-by-side Street View shots of that house and the one where she got killed. They’re both brick, one-story, corner houses, with many superficial similarities. At her level of intoxication, and in the dark, it’s very plausible she thought it was her own house after wandering or passing out for a couple of hours. Of course we’ll never know now.

“From everything I’ve read about this situation there doesn’t seem much to mitigate the crime.” I agree. If he indeed fired through a closed / locked screen door, it will be very difficult to convince a jury that he reasonably feared death or great bodily harm. And even if the shot itself was “accidental” (i.e. *negligent*), that means he had to have his finger on the trigger while pointing the gun at McBride’s head — which satisfies one of the alternative mens rea elements of Murder 2: “knowingly created a very high risk of death or great bodily harm knowing that death or such harm would be the likely result of [his / her] actions” (http://mi-criminal-defense.com/2nd-degree-murder.html).

This incident illustrates the dangers of gun ownership by people who have not learned gun safety, or thought much about the consequences of the shoot / don’t-shoot decision in the heat of the moment. If you haven’t been trained or read a good book about the use of force (like Massad Ayoob’s “In the Gravest Extreme”), and you don’t have the practice / training to keep your finger off the trigger until you know you have to shoot, thus preventing an “accidental” discharge, then you may just fuck up and kill somebody one day when you didn’t have to, and at that point your life is *fucked*, right along with that of your victim and your victim’s family.

Zimmerman / Martin illustrated that even if you make a legitimate self-defense shoot, your life may still be fucked. This doesn’t look like a legit self-defense shoot, and barring some shocking new undisputable evidence that she was doing something to threaten his life, Mr. Wafer is screwed, and rightfully so. Anyone considering keeping a gun for protection needs to consider these issues very carefully, long before they’re put in a situation where they have to make a life and death decision.

    • “[T]hat means he had to have his finger on the trigger while pointing the gun at McBride’s head — which satisfies one of the alternative mens rea elements of Murder 2: ‘knowingly created a very high risk of death or great bodily harm knowing that death or such harm would be the likely result of [his / her] actions’”

Most people, if you hand them a firearm, will automatically put their index finger in the trigger guard, which is a no-no, even if it’s unloaded and everyone knows it’s unloaded, but nonetheless you can bet that it’ll happen virtually every time. In fact, I recall reading of or hearing a dealer at a gun show lamenting that most people would do precisely that, especially if that’d been offered a pistol/revolver to inspect, butt-first.

My counter to your argument would be that the thing (the firearm) was designed to entice the holder to immediately place his finger inside the trigger guard, and consequently “on” the trigger. Doing the alternative, placing the index finger on the front exterior of the trigger guard (like you should), is not in the design; there’s no “trigger-finger rest” that’s clearly present. And besides, under the circumstances, where else was I going to put my finger? Up my butt?!

Then I’d (or my lawyer-puke would) try to flip the whole thing onto the manufacturer of the firearm, who would probably, most assuredly have the legal resources and money to fight them into the dirt.

The guy did make a terrible mistake, though.

  17. “Renisha had BAC of approximately 0.26 at the time of the accident at 1:00 AM (given that alcohol burns off at 0.015/hour).”

Possibly. She also could have had a bottle in her coat pocket and spent some of the time gap after the crash drinking it. At her weight, a .21 or .22 is consistent with having about 10-12 shots in a 2-4 hour period. I saw news reports saying she left her house at 11, only a couple hours before the crash — which doesn’t allow a lot of time for her to have had 12 drinks. Most 19-year-olds haven’t been drinking long enough to have built up enough tolerance to take 12 drinks in a couple of hours and still be able to start a car and get it very far out of the driveway before crashing. I wonder how close her friend’s house was to the crash site?

Another possibility is she had her last few drinks immediately before she got on the road, so her BAC was still rising at the time of the crash as the alcohol was absorbing into her bloodstream, then peaked sometime after the crash as it was fully absorbed, and then got metabolized down to .21. No doubt that .21 is phenomenally wasted, however.

  18. Suburban Detroit whites are often racist, particularly about Detroit residents, and the local news leads off almost every day with some murder or arson in the city, or by a city resident who traveled into the suburbs.

The City of Detroit once had about 1.5 million whites, now it has about 50,000. Many hold a grudge over what they perceive to be a forced displacement.

Also, the majority of Arabs in the Dearborn area are Christian, though that is slowly changing.
