“Nuclear option” what stupid name

with 7 comments

“Nuclear” sounds like a huge apocalyptic explosion with massive fatalities. In contrast, changing the rules of procedure for the Senate is a big yawner.

The rule that allows filibusters is pretty dumb anyway. Maybe it made sense in the 1800s when the Senate didn’t do that much so they had a lot of free time to waste, but it doesn’t make sense anymore.

I urge the mainstream media to stop calling it that.

  1. I don’t know. Perhaps it’s a useful phrase in that it would make it clear to Republicans that the first side to shoot wins. Since you know that the other side will do it eventually, they need to go ahead.

  2. I think they call it “the nuclear option” because it changes rules they have had for a long time, it is like “blowing up the world,” and reflects a collapse of traditions and norms, the expiration of a more gentlemanly system in which people tried a little harder to work things out and were reluctant to unleash all their weapons over every little issue.

Of course, I definitely want the GOP to do whatever it takes to get Gorsuch on the court ASAP, and I blame the Democrats for wrecking Congressional traditions.

  3. It’s nuclear because getting rid of the filibuster is breaking an extremely important norm in American politics.

America is not a parliamentary democracy. The American form of government has always depended on bipartisanship to properly work. The filibuster is a guardrail of consensus. Ending the filibuster buries even the pretense that were are one country instead of just 2 warring tribes that want to exterminate the other.

  4. All things being equal, I don’t mind having a 60 vote majority in the Senate for most things. It has kept a lot of crap legislation from getting through. But it doesn’t seem to have any utility for approving appointments. They have to go through regardless, so 60 votes tends to put a drag on things for that.

So go ahead McConnell. Turn the key and pull the lever into the “launch” position.

That pretense needs to end, if it hasn’t already.

  6. They should restore the traditional filibuster whereby senators had to hold the floor to prevent a vote. But the 60 vote super majority is a good thing at some point your opponents will be in power and it’s good to have a restraint on power.

The problem started when the democrats decided to prevent votes on W’s judicial appointments. Until then it was a straightup or down vote for judges.

The fly in the ointment is that the Democrats will nuke the 60 vote threshold the next time they are in power.
