The DACA injunction

The extreme-liberal judge’s injunction against Trump ending DACA will eventually be overruled by the Supreme Court.

Until that happens, I predict the following:

1. Trump, who gets very angry when he’s not respected, will insist that much more on ending DACA.

2. The Democrats will never agree to a deal that keeps DACA gut gives Trump other restrictionist immigration laws because now they think they can win in the courts.

Therefore, thanks to this extreme-liberal judge, nothing gets passed, and DACA will eventually be dismantled after it gets to the Supreme Court, although liberal judges can delay the dismantling for at least another two years.

  1. Here’s a thing about DACA. Nobody has considered the possibility that even after DACA is formally over, the DOJ will be ordered surreptitiously to avoid deporting the people who were formerly enrolled in it. After all, ICE already works on a basis of prioritizing who to deport.

    • IHTG, that was an interesting test-question, several days’ worth of posts back, about how to decide whether you’re American Nationalist or White Nationalist. (I’m American Imperialist, personally.) You said that if you’d prefer that 10 million Whites and Sub-Saharan Africans hook up and babify to 20 million Mexicans living in autonomous no-go zones you’re American Nationalist. So I thought about that and decided that as long as as many White men get to have SSA women as SSA men get to have White women I’m okay with it. Man, there was a really beautiful West Indian SSA checkout girl at the supermarket on 4th Ave and 25th St. (Brooklyn) this evening. She was way out of my league. You’d have to make $150,000/yr at least for a woman like that.

      • I never thought I was a WN, but I nevertheless read this and thought, “Hey, don’t you go calling me an American Nationalist!” Thing is, I love white people, I just don’t have any of the fixation the edgelords do with race-mixing. In this scenario, you’re basically talking about introducing a new 10+ million strong Cape Coloured population in America, mixed in with the rest of society. That sounds a lot better to me than 20 million Mexicans in no-go zones. I’m assuming the whites wouldn’t be forced to marry random SSAs, so hopefully a lot of them would pick the cream of crop to marry. Some of their children would probably be high achievers.

      • A lot of black women are gorgeous. Most of them are not American. There is an African chick at my local library who is not conventionally pretty in the white girl sense, but she is tallish, very slender and hyper feminine. In fact in the girly girl category she makes Asian chicks look butch. Howzat? Why are African-American women so aggressive but their racial sistahs from actual Africa the opposite? Can certain behavior patterns be entirely sociological and have nothing to do with genes?

  2. The Democrats don’t expect to win this fight in the courts, but they aren’t gonna compromise for 3 reasons:

    1. The Dems truly believe in open borders and would never sign off on any meaingful immigration restriction, legal or illegal.

    2. The Dems are afraid of the (ultimately toothless) immigration activists in their base because they are pussies.

    3. The Dems cannot give Trump anything that Trump could construe as a win.

    I’m happy to see people freaking out over this because it strengthens the hand of the hardliners in the admin, but really there is nothing to be worried about. DREAM Act isn’t gonna happen and wasn’t going to happen.

    • What the Senate Republicans should do is play chicken with DACA: Attach a Dream Act bill to the Raise Act and wall funding and dare the Democrats to filibuster it.

      If the Democrats filibuster they will receive the blame for killing the amnesty.

      If the Democrats are bluffing they end up passing Trump’s immigration priorities.

      Either way is a win-win for Trump.

      In lawmaking understanding which Branch of government has the burden to act is a fine art that often determines whether legislation will pass or fail and who ends up with the political advantage. There are many instances where one chamber of Congress will publicly apply pressure on the other chamber to pass or reject legislation. Often this pressure to make someone else act is as much about shifting blame if something goes wrong as much as it is about legislating: The House, for example, may ask the Senate to pass a bill everyone privately knows the Senate cannot pass in order to save the House grief for inaction.

      On the other side of the coin, kicking the ball into someone else’s court at the right time in the legislative process is a great way, if done properly, to break Congressional deadlock.

      • This appears to be what the House bill does. Essentially the White House 70-point immigration plan in exchange for 3-year work permits for the Dreamers (who will be extremely vetted no doubt). Presumably then the Dreamers could apply for green cards during or after this 3-year period and any approval would come under the new merit-based requirements and count against the new, lower annual numbers.

      • Let Trump appear to negotiate in public with the Democrats for a few weeks.

        But when it’s crunch time, call the Democrats’s bluff by tying DACA to the wall and the Raise Act.

        If it’s DACA + wall funding + Raise Act or nothing, the burden to act will all be on the Democrats – if they filibuster, Trump blames them for not bringing the bill up for a vote. If they fold, Trump gets his immigration reforms through.

      • The insanity of this whole situation is that leftists are claiming Obama had the right to create something by executive order that Trump doesn’t have a right to rescind by executive order. Either trump has a right to rescind it or Obama never had a right to make it. They can’t have it both ways.

      • The ruling uses the following cloud-cuckoo-land reasoning:

        1. According to the President’s public statements he is in favor of DACA but is rescinding it because he believes it to be unconstitutional. 2. The Court asserts that DACA is constitutional. 3. So the Court is blocking the rescindment to correct the President’s legal error and better reflect the President’s intent.

        Setting aside for the sake of argument the question of whether DACA is constitutional[1], this is an absurd ruling, which in saner times would be impeachable judicial misconduct, for the following reasons:

        * The President may rescind an executive order for any reason, even an “erroneous” one.
        * The President’s reasoning for rescinding an executive order is a political question outside the purview of the Court.
        * The constitutionality of DACA is not the question before the Court.
        * The argument that ruling for Plaintiff reflects the President’s intent is self-refuting, as Plaintiff is suing the President.
        * Plaintiff lacks standing to sue the President with regards to this matter.
        * The President’s intent is a political question outside the purview of the Court.
        * Blocking the President’s ability to take action cannot reflect the President’s intent because the President may intend to take that action, or may in the future.
        * Further, even in the hypothetical scenario the President sided with Plaintiff and declined to defend the lawsuit, it would remain unconstitutional for the Court to usurp the President’s powers in such a manner.
        * As immigration is a matter directly pertaining to national security, the President’s decisions may be informed by non-public information. The Court therefore cannot assume the President’s complete intentions from public statements only.

        [1] I would argue clearly NO, because it raises revenue (the application fees which make it “self-funding”) without Congressional authorization, and abrogates Congress’s power to make laws and fix penalties.

      • What I don’t understand is why there isn’t more outrage over this decision. Isn’t this the kind of thing that usually gets some on the right fantasizing about civil war to rein in the courts? It certainly does to me. How can the courts possibly have the authority to block a president from rescinding an executive order by a previous president? What would happen if Trump simply ignored this decision? Is the government now completely controlled by the judiciary, who have absolute power to direct the actions of the government to comport with liberalism? What’s next, some judge decides it’s unjust that America never made slavery reparations, orders Congress to start paying blacks, and Congress just dutifully rolls over and does it?

  6. The Democrats are awfully cagey, you’ve got to hand it to them. Immigration per se is not about all the things they insist it is: diversity, helping the world’s unfortunate, “who we are,” “a nation of immigrants,” or any of that crap. Immigration is about creating public sector jobs via the welfare state that will generate public employee union contributions to the Democrat party. Having tens of millions of poor, non-English speaking, welfare consuming people in the country that make middle class white people feel like strangers and patsies in their own country is just icing on the cake.

    Trust me, if there were evidence that immigrants were more self reliant than citizens, and tended to vote GOP once they became citizens, the Democrats would be in favor of an electrified fence on the southern border and a complete moratorium on all immigration in perpetuity.

      • There are various Jewish ethnicities that comprise Israel. If you don’t believe me, then consult Gregory Cochran, who is a patron saint of the old HBD crowd. He taught me that.

        Then there are “Israeli Arabs”, or whatever you want to call them, who comprise some 20% of the state. Most are Muslim but there are dozens of sects.

        France, on the other hand, officially doesn’t care what religion, race, or culture they are. They don’t even keep statistics on that, and their immigration doesn’t restrict on that basis. Or else they think everyone in the world can be French, regardless of language, culture, language, and religion. They want “France” to commit suicide.

        Israel wants to live. Those countries are nothing alike.

        2) Most French Muslims are third and fourth generation Islamic immigrants, not recent immigrants.

        3) Israel CAN reduce their Muslim minority by expelling Muslim Israelis. But Israel doesn’t expel them because Israel isn’t an ethnostate.

        Unless you insist on clinging desperately to the altright’s fool definition that logically makes France as much of an “ethnostate” as Israel.

        Let’s say society were to accept that some groups are inferior intellectually and morally to other groups. Then you’d have to accept that you personally are inferior to some others. This may explain why you don’t have A, B, C things you want, but it also means some of these things are forever out of your reach.

        Few people are willing to accept that their failures are due to their place in a natural hierarchy. Instead they prefer to think that, had circumstances been different, they would have gotten that job, that girl, that money, that prestige. It’s just bad luck, right?

    • The level of diversity in the UK prior to 1970 was probably ideal. A wide sample of diverse people but none of them in large numbers. The UK had immigrants from everywhere – Jamaicans to Pakistanis to Hungarian Jews to Chinese to Polish gentry to Southern Italian peasants. To say nothing of hundreds of thousands of Irish. But all total those immigrants (maybe ignoring the Irish) certainly were no more than 2-3% of the population. Almost of all them were well on their way to being absorbed into the larger British nation, much as previous small waves of Huguenots, Poles, Dutch and Germans had been absorbed over the centuries. There were enough immigrants to keep new ideas coming in and stimulate innovation but not enough to form power blocs opposed to the dominant culture. Certainly people of partial Russian immigrant stock like Helen Mirren or Peter Ustinov made the UK a more interesting place to live, but both Mirren and Ustinov were culturally first and foremost English. Not hyphenated Russian-Brits.

The Rabbis, who up until then staunchly denied the Jewish credentials of the Ethiopians, suddenly gave in. Clever – they are like the Mormons on race (and plural marriage) – when it helps politically, they can change on a dime. If memory serves they fabricated a fictitious lineage from one of the tribes.

      Actually the Rabbis were right, the Ethiopians are non-Jewish on the maternal side, and thus do not qualify as Jews. I was in the country during the airlift and I can tell you that a lot of people didn’t like it, and they fabricated an excuse to stop the airlift (although later on the Beta Israel, as they were now called were mostly transferred to Israel piecemeal).

      In my experience, in Israel, it helps to be Ashkenazi, although we come in for a shitload of ribbing. Next to that, Yemenite, and after that, any good looking Mizrahi. Everyone else is at the bottom of the barrel.

      • I believe they use the law that Reagan signed to allow Asians cheap govt loans, which white US citizens can’t get. Pakis and Indians also own a lot of Dunkin Donuts and gas stations among other things. They then bring in their family members through chain migration that work in them.

        In the 70’s you would go into any 7-11, gas station, fast food place and find white people owning and working in them. Now it’s like you step into a foreign country on entry. That started to change in the 80’s.

        In the 70’s this was still a white country with maybe 10% black population that you could avoid for the most part. Not anymore.

    • Good luck with that. My brother, who is the finance director at a small city in LA county once wrote to what was then Business Week magazine to explain how these things work. He noted that public pension funds (at least back then) had a fiduciary duty to invest their money for highest return, period. “Sin stocks,” oil companies, businesses that had dealings with Israel, etc. etc. could not be excluded simply because the politicians did not like them. Virtue signaling invariably and inevitably collides with the real world imperative actually make money.

The government has no problems putting people in jail for tax evasion and confiscating their property. Surely that has an effect on their children.
