  5. Although I’m glad RGB is doing well, she really was very selfish not to have retired during the Obama administration. Her desire to remain on the court for personal reasons is understandable but more than just her own happiness is at stake. Liberals across the country count on the seat she occupies remaining liberal, and she knew she was in her early 80’s and had no way of assuring the Obama’s successor would be a Democrat. Her chances of dying or having to retire before Trump’s successor takes office (even if he loses in 2020) are quite high.

      The reason she didn’t retire was that she was trying to break the record Oliver Wendel Holmes set at age 91 as the longest serving SCOTUS Justice.

      • A Supreme Court clerkship is the most prestigious gig in the legal profession, other than federal judge, US Attorney or state attorney general.

      • Speaking of SC clerks, is there some rule that these people can only come from the Ivy League and never from any other law schools? It seems kind of discriminatory to exclude all others.

    1) This assumes the fall that fractured her ribs wasn’t caused by some other body parts failing.

    2) The Soviet Union insisted Andropov was in superb health the day after he was treated from the kidney failure he would die from a year later.

    • That’s just it. Sometimes people fall inadvertently, tripping over something for example, but especially in older people there’s often some medical reason for the fall.

    • Nobody is “just fine” two days after breaking three ribs, no matter how tough they are. Like you, I wish her no ill will, but this claim that she’s shrugged off her injuries is absolute BS, unless she was never injured in the first place. (before it starts, I mean misdiagnosis, not some conspiracy)

      • She is probably sitting up because it hurts too much to lie down. I remember after my son broke a rib snowboarding he slept in a chair for awhile. I’m sure it is BS that she is shrugging it off if my fit teenage son couldn’t shrug it off.

        If she wanted to dodge the ceremony she would come up with any typical excuse people make to skip a day at work or avoid meeting unlikable relatives – they have to attend a wedding, go for a routine dental appointment, etc.

        But she wouldn’t go through an unnecessary hospital stay when any BS excuse would work to miss Kavanaugh’s ceremony.

  10. As others have said, no one with broken ribs is doing fine. Especially not a frail 85 year old with previous health problems. Even before she fell she wasn’t “doing fine”.

  11. now her breathing is shallow because of the rib pain…that is how pneumonia gets in the lung…now is the most dangerous time for her…

  12. Extended hospital stays are dangerous, because of the probability of infection. She should be removed as soon as possible, and convalesce at home. And I agree with active pooter, pneumonia is the main threat now.

  13. I double checked on the longest serving justice, and it turns out that William Douglas still holds the record at 37 years. He beat Stephen Fields, who also had to be persuaded to retire because he had gone senile.

    I had thought John Paul Stevens beat Douglas, but Stevens retired at 35 years. Stevens is still alive at 98 years old. He wrote an interesting book, which I have, on the constitution after leaving the bench so he probably could have gone longer before senility set in.
